The Berlin Wall Foundation processes personal data exclusively in compliance with the applicable European and German data protection regulations, especially the EU GDPR (General Data Protection Regulation), the German Federal Data Protection Act [Bundesdatenschutzgesetz/ BDSG], the Berlin Data Protection Act [Berliner Datenschutzgesetz/ BlnDSG] and the German Telemedia Act [Telemediengesetz/ TMG].

When you visit the Berlin Wall Foundation’s websites certain general information is automatically stored temporarily in so-called server log files. This information includes:

• the time of access
• the operating system of the requesting terminal device
• the browser used (type and version of browser)
• the Internet protocol address (IP address), shortened by the last digits for the purpose of anonymisation
• the referring URL (referrer)
• the name and number of pages accessed
• the time spent on the page
• the search engine used, if applicable

This information is required to enable us to deliver the contents of our websites correctly. Furthermore, it is used for the statistical evaluation and optimisation of the internet services offered by the Berlin Wall Foundation. This anonymous data on the server log files cannot be used to draw conclusions regarding your person. These data are not aggregated with other data sources. However, the Berlin Wall Foundation reserves the right to subsequently check the server log files if concrete evidence of unlawful use should arise.

The websites of the Berlin Wall Foundation use cookies. These are small files which your browser stores on your terminal device (computer, laptop, tablet, smartphone, etc.) when you visit one of our websites listed under Item 1 in this Data Protection Notice. Cookies do not cause any damage on your device; they include no viruses, Trojans or other malware. Cookies are used to make Internet services more user-friendly. For example, they save the pages you access while visiting the website or the language settings you have made. With the help of cookies, the device with which this website was accessed can also be recognized when it is accessed again. However, this does not mean that we thereby obtain direct knowledge of your identity. The use of cookies for the specified purposes constitutes a legitimate interest within the meaning of Art. 6 (1) f GDPR.

Most browsers accept cookies automatically. However, your browser can be configured in such a way so as to restrict or prevent cookies from being set. For example, only those cookies which come from third-party providers may be blocked, or all cookies may be accepted. Nevertheless, completely deactivating cookies may result in the loss of some of the functions on our website.

Our website integrates fonts provided by Monotype Imaging Holdings Inc., Woburn, USA, under the brand name of fonts.com. When you visit our website, a connection is established with Monotype Imaging Holdings Inc.’s servers and your IP address is transmitted for licensing and invoicing reasons. The IP address is stored by the provider in a non-anonymised form for 30 days. After this deadline, it is fully deleted; as a result, no personalised data are stored any longer.

Fonts from fonts.com are used to ensure that our online services are presented in an appealing manner. This constitutes a legitimate interest within the meaning of Art. 6 (1) f GDPR. The Berlin Wall Foundation’s websites use the Google Fonts library (https://fonts.google.com/). Google fonts are transferred to your browser’s cache to avoid multiple loading. If the browser does not support Google fonts or prevents access, contents are shown in a standard font.

Calling the font library automatically triggers a connection to the library operator, whereby it is theoretically possible for the operator to collect data.

YouTube videos are embedded on some of the Berlin Wall Foundation’s websites. The operator of the corresponding plugins is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit a site with an embedded YouTube video, a connection is established with YouTube’s servers. YouTube is informed which pages you are visiting. If you have a YouTube account and are logged into this account, YouTube can analyse your surfing behaviour and assign it to you personally. You can prevent this by logging out of your YouTube account before you visit our websites.

When a YouTube video is started, the provider uses cookies which, to some extent, gather information on user behaviour. You can block these cookies from being stored by enabling the appropriate settings on your browser.

The Berlin Wall Foundation’s websites sometimes use Google Maps to present geographical information visually. When Google Maps is used, Google also collects, processes and uses data on how the map functions are used by visitors to the site. There are maps on some of the Berlin Wall Foundation’s websites which record the location of certain facilities of the Foundation and are based on geographical data from OpenStreetMap. OpenStreetMap is a project which aims at collecting freely editable geographical data and providing them in a database for everyone’s use (Open Data). The map services are operated by OpenStreetMap Foundation (OSMF), 132 Maney Hill Road, Sutton Coldfield, West Midlands, B72 1JU, United Kingdom. To enable the maps to be shown to you, your IP address is forwarded to OpenStreetMap. Furthermore, a so-called session cookie is stored on the visitor’s computer. For further information, please refer to OpenStreetMap’s Privacy Policy

Individual websites operated by the Berlin Wall Foundation use Matomo (formerly Piwik), an open source software for the statistical analysis of visitor access. Matomo also uses cookies which are stored on your terminal device. The information generated by the cookie regarding your use of the websites is stored together with your IP address in an anonymised form on the Berlin Wall Foundation’s server. This server is located in Germany.

If you do not agree to having the anonymised data from your visit stored, it requires only a mouse click to object to having them stored on those Berlin Wall Foundation’s websites which use Matomo. In this case, a so-called opt-out cookie will be stored in your browser and, as a result, Matomo will not collect any session data. NB: If you delete your cookies, the opt-out cookie will also be deleted and you may have to reactivate it.

Basically, it is possible to use the Berlin Wall Foundation’s websites without giving any personal data. To the extent to which personal data such as names, addresses, telephone numbers or e-mail addresses are collected, this is always done on a voluntary basis.

Collecting personal data becomes necessary if you wish to make use of certain services offered by the Berlin Wall Foundation, such as when you wish to book a tour or seminar or use one of the contact forms to make an inquiry.

If you send an inquiry on one of the forms provided by the Berlin Wall Foundation for that purpose, your data on the inquiry form, including the contact details you have entered on the form, will be stored for the purpose of processing the inquiry and possibly planning and carrying out a requested tour or participation in a seminar as well as for statistical analysis.

The data you have entered will only be transmitted and stored if you explicitly agree to this. Your consent shall be deemed as granted if you have ticked the corresponding checkbox in the individual inquiry form.

Your personal data will not be transmitted to third parties unless: (a) you give us your consent to do so within the scope of the respective intended purpose, (b) the Berlin Wall Foundation is obliged by law or a judicial decision in individual cases to do so, or (c) an attack on the Internet infrastructure of the Berlin Wall Foundation makes it necessary to disclose this data to law enforcement authorities for the purpose of law enforcement.

If you wish, you can receive regular information by e-mail on events, exhibitions and other projects from the Berlin Wall Foundation. This service includes both a quarterly newsletter of events as well as information on individual activities carried out by the Foundation at irregular intervals. In addition, journalists can enter their name on our press mailing list to receive regular press releases by e-mail.

Appropriate forms are available on the Berlin Wall Foundation’s websites to register for this service.

Registration is only valid if we receive a valid e-mail address. Entering your first and last name is voluntary; this serves only to personalise your e-mail. We use the “double opt-in” method to verify that registration has actually been completed by the owner of an e-mail address. After you have registered, you will receive an e-mail in which you are requested to confirm your registration by clicking on a corresponding link.

Registration data are used exclusively for sending the newsletter of events and information on individual activities. They are not transmitted to third parties.

To show evidence of the registration process in accordance with legal requirements, we log orders for the newsletter of events, invitations to individual activities, the sending of a confirmation e-mail and receipt of the response requested in it. By clicking on the link in the confirmation e-mail, you give your consent to the storage of this data.

You may revoke your consent to the storage of your personal data and their use for sending the newsletter of events and invitations to individual activities at any time. A corresponding link can be found in each e-mail. We use rapidmail for sending our newsletter. When you register, you consent to have the data entered transmitted to rapidmail. Please also note their General Terms and Conditions and Data Privacy Policy

On our website „Arriving - Life After Forced Migraftion“ you can use the “Heimat-Builder” tool to upload your personal pictures and files with the aim to creatively participate and create your own collage based on your idea of Heimat. The provision of your personal data is necessary for uploading your collage and publishing it in the gallery. We will process and store the information you provide (name, email address). If your collage includes further personal data, it will similarly be processed and stored. The permission of use you provided to the Berlin Wall Foundation can be revoked at any time with effect for the future. In case of revocation, the collage will be removed from the Heimat-Builder gallery. Apart from the use of third-party services (such as Google Maps) as set out in Items 2.2 to 2.7 of this Data Protection Notice, your personal data will not be transmitted to third parties for any other purposes than those set out below.

We will only transmit your personal data to third parties if:

• you have given us your explicit consent to do so pursuant to Art. 6 (1) first sentence (a) GDPR,
• transmitting these data is required to assert, exercise or defend legal claims pursuant to Art. 6 (1) first sentence (f) GDPR and there is no reason to assume that you have an overriding interest worthy of protection regarding the non-disclosure of your data,
• there should be a case in which there is a legal obligation to transmit such data pursuant to Art. 6 (1) first sentence (c) GDPR, as well as
• if this is legally permissible and, pursuant to Art. 6 (1) first sentence (b) GDPR, necessary for the implementation of contracts.

You have the right:

• in accordance with Art. 15 GDPR, to request information regarding your personal data which we have processed;
  In particular, you may request information on the purpose(s) for processing this data, the category of the personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if they have not been collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about their details.
• in accordance with Art. 16 GDPR, to request the correction of incorrect personal data or the completion of your personal data stored with us, without undue delay;
• in accordance with Art. 17 GDPR, to request the erasure of your personal data stored with us, unless processing is necessary to exercise the right of freedom of expression and information, to comply with a legal obligation, for reasons of public interest, or to establish, exercise or defend legal claims;
• in accordance with Art. 18 GDPR, to request the restriction of processing your personal data to the extent to which you dispute the accuracy of the data, such processing is unlawful but you object to their deletion and we no longer require the data, but you need them to assert, exercise or defend legal claims, or you have objected to such processing in accordance with Art. 21 GDPR;

If your personal data are processed on the basis of justified interested in accordance with Art. 6 (1) first sentence (f) GDPR, you have the right in accordance with Art. 21 GDPR to object to the processing of your personal data provided there are reasons for doing so which arise from your particular situation or your objection is directed against direct advertising. In the latter case, you have a general right of objection which will be implemented by us without your specifying a particular situation.

Access to our websites is encrypted using the SSL (Secure Socket Layer) procedure. In each case, the highest encryption level which is supported by your browser will be offered. Generally, this is a 256-bit encryption.

We use appropriate technical and organisational security measures to protect your personal data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in accordance with technological development.
